Terms of Service

These Terms of Service ("Terms") govern your use of TVLEVEL, available at tvlevel.com (the "Service"). The Service is operated by the individual behind TVLEVEL ("TVLEVEL", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What TVLEVEL Is
TVLEVEL turns a product photo and a short brief into an AI-generated video advertisement. You upload an image, choose options such as a visual style, and our pipeline uses artificial intelligence to generate ad concepts and a finished video. The Service is provided on an "as is" basis, and we may add, change, suspend, or discontinue features at any time.
2. Eligibility
You must be at least 18 years old to use the Service. By using TVLEVEL you confirm that you are 18 or older and legally able to enter into these Terms. You may use the Service for personal or business purposes.
3. Your Account
You need an account to use most of the Service. You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at support@tvlevel.com if you believe your account has been accessed without your permission. The information you provide must be accurate and kept up to date.
4. Tokens, Pricing and Payment
The Service runs on tokens. You buy tokens up front, and each video generation spends tokens. Prices are shown on the purchase page in U.S. dollars and may change over time; changes do not affect tokens you have already bought. Payments are processed by our payment provider, Dodo Payments — we do not store your full card details. You are responsible for any taxes that apply to your purchase where required by law.
Tokens are charged when you start a generation. They have no cash value, cannot be transferred or exchanged for money, and are only redeemable for generations within the Service.
5. Refunds
Token purchases are final, and we do not provide cash refunds. If a generation fails because of a problem on our side, we re-credit the tokens (not money). The full details — what qualifies, what does not, and how to request a re-credit — are in our Refund Policy, which forms part of these Terms.
6. Acceptable Use
You agree not to use the Service to create, upload, or distribute content that:
- is illegal, or promotes illegal or dangerous activity;
- infringes anyone else's intellectual property, privacy, or other rights;
- contains a real person's image, likeness, or voice without their permission, or impersonates a real person or brand (including deepfakes);
- is hateful, harassing, defamatory, sexually explicit, or depicts graphic violence;
- is misleading or deceptive advertising, or makes false claims about a product;
- targets or exploits minors; or
- contains malware, or is used to scrape, overload, reverse-engineer, resell, or otherwise abuse the Service.
You are solely responsible for the content you upload and the videos you generate, including making sure you have the rights to any product, logo, brand, or person shown, and that your use complies with the law and with the rules of any platform where you publish.
7. Your Content and Ownership
You keep ownership of the images and briefs you upload ("Your Content") and of the videos you generate with the Service ("Outputs"). Subject to these Terms, you are free to use your Outputs for personal and commercial purposes.
To run the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, process, and modify Your Content and Outputs as needed to operate, provide, secure, and improve the Service.
You also grant us a license to display and share your Outputs (and the product imagery within them) to promote and showcase TVLEVEL — for example in galleries, social posts, or ads. If you would prefer that we not feature a specific video, just email support@tvlevel.com and we will stop using it going forward.
Because Outputs are generated with AI, we cannot guarantee that they are unique — another user could provide a similar brief and style and receive a similar result.
8. AI-Generated Content
Outputs are produced by automated AI systems. They may contain imperfections, artifacts, inaccuracies, or unexpected results, and they will not always match your brief exactly — generating more than one video is sometimes needed to get a result you like. We do not guarantee any particular outcome, quality, fitness for a purpose, or commercial result. You are responsible for reviewing every Output before you use or publish it.
9. Our Intellectual Property
The Service itself — including the platform, software, pipeline, visual styles, prompts, models, designs, and the TVLEVEL name and branding — is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. You may not copy, modify, resell, or reverse-engineer the Service or its underlying components.
10. Third-Party Services
We rely on third-party providers to run the Service — for example for hosting, authentication, storage, payments, email, and the AI models that generate your video. Your use of the Service depends on these providers, and your content is processed by them as needed to deliver the Service. We are not responsible for outages or issues caused by third-party providers. Our Privacy Policy lists the main providers we use.
11. Service Availability and Maintenance
We work to keep the Service running, but we do not guarantee that it will be available, uninterrupted, or error-free at all times. From time to time the Service — including the website and the systems that generate your videos — may be slow, temporarily unavailable, or taken offline. This can happen for planned maintenance, updates, or upgrades (with or without advance notice), or because of unplanned issues such as outages, technical failures, problems with the third-party providers we rely on, or events outside our reasonable control (for example, internet, hosting, or network failures, or force majeure).
We are not liable for any unavailability, downtime, interruption, delay, or data loss arising from these events, and we do not offer any uptime guarantee, service-level commitment, or compensation for downtime. If a generation is affected, our Refund Policy explains when tokens are re-credited.
12. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law, TVLEVEL will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three (3) months before the event giving rise to the claim, or USD 50.
14. Indemnification
You agree to defend, indemnify, and hold harmless TVLEVEL from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your breach of these Terms or of the law.
15. Termination
You can stop using the Service at any time and ask us to delete your account by emailing support@tvlevel.com. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where necessary to protect the Service or other users. Unused tokens are forfeited on termination for a breach. Sections that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the date at the top of this page and, for material changes, take reasonable steps to let you know (such as a notice on the site or by email). Continuing to use the Service after changes take effect means you accept the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Delaware and the applicable federal law of the United States, without regard to conflict-of-law rules. If a dispute arises, you agree to first contact us at support@tvlevel.com so we can try to resolve it informally. Any dispute that cannot be resolved that way will be subject to the courts located in Delaware, United States.
